Terms and Conditions for Hajj Guides Website

Welcome to Hajj Guides. These Terms and Conditions govern your use of our website, support services, seminars, webinars, guidance services and any additional services offered by Hajj Guides. By accessing our website or using our services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

1. Definitions

“Hajj Guides”, “We”, “Us”, “Our” refers to Hajj Guides.

“You”, “Your” refers to any individual accessing our website or using our services.

“Nusuk Hajj” refers to the official Hajj booking platform authorised by the Ministry of Hajj and Umrah in the Kingdom of Saudi Arabia.

“Hajj Provider” refers to the licensed Hajj service provider whose packages are offered through the Nusuk Hajj platform.

“Additional Services” refers to optional services provided directly by Hajj Guides, including but not limited to seminars, webinars, training, educational materials, guidance services, support services, administration assistance, logistics support, airport assistance, guide allocation, communication platforms, and other ancillary services.

2. Our Role

Hajj Guides is an independent Hajj guidance, education, and support organisation that works in partnership with licensed Hajj Providers participating in the Nusuk Hajj platform.

The Hajj Providers we work with may allocate specific Hajj packages to Hajj Guides for promotion, guidance and pilgrim support. Our objective is to help pilgrims identify the most suitable package based on their individual requirements, preferences, budget, accommodation expectations, mobility needs and travel circumstances.

While Hajj Guides may recommend or promote specific packages allocated to us by a Hajj Provider, our guidance is intended to assist pilgrims in selecting the most appropriate option available. Where we believe that another package offered by the same Hajj Provider may better meet a pilgrim’s needs, we may recommend that alternative package.

Our services may include:

Providing information on Hajj packages allocated to Hajj Guides by participating Hajj Providers.
Advising pilgrims on the suitability of available package options.
Assisting pilgrims in understanding package features, accommodation locations, transport arrangements, and service levels.
Providing educational seminars, webinars, training sessions, and pre-Hajj guidance.
Offering administrative and logistical support before, during, and after Hajj.
Facilitating communication between pilgrims and the Hajj Provider where appropriate.

Hajj Guides does not own, operate or control any Hajj package and is not the contractual provider of Hajj services.

The contract for any Hajj package is entered into directly between the pilgrim and the Hajj Provider through the official Nusuk Hajj platform. All package terms, pricing, availability, accommodation allocations, transport arrangements, flight schedules, and service delivery remain the sole responsibility of the Hajj Provider and are subject to the rules and regulations of Nusuk Hajj and the Kingdom of Saudi Arabia.

Hajj Guides cannot guarantee that a specific package, hotel, room type, transport arrangement, guide allocation, or service will remain available and reserves the right to recommend alternative packages from the same Hajj Provider where this is considered more suitable for the pilgrim’s circumstances.

Package Recommendations

By registering your interest with Hajj Guides, you acknowledge that Hajj Guides may contact you regarding Hajj packages allocated to us by our partner Hajj Providers.

Where appropriate, Hajj Guides may recommend alternative packages offered by the same Hajj Provider if, in our reasonable opinion, those packages are more suitable for your requirements, budget, accommodation preferences, group size, mobility needs or other stated circumstances.

Registration of interest with Hajj Guides does not constitute a reservation, guarantee of availability or contractual entitlement to any specific Hajj package.

3. Hajj Package Bookings and Payments

Hajj Package Payments

All Hajj package payments must be made directly through the official Nusuk Hajj platform.
Hajj Guides does not collect, process, hold, manage, or control payments for Hajj packages.
Hajj Guides does not have access to, control over, or responsibility for any payment transactions made through Nusuk Hajj.
All financial obligations relating to Hajj packages are governed by the terms, conditions, and regulations of Nusuk Hajj, the Hajj Provider, and the applicable laws of the Kingdom of Saudi Arabia.

Package Availability

Hajj package availability, pricing, accommodation allocations, transport arrangements, flights, services, and package features are determined solely by the Hajj Provider and Nusuk Hajj.
Hajj Guides cannot guarantee the availability of any specific package, room type, hotel, flight, transport arrangement, or service.

Package Changes and Upgrades

Any package upgrade, downgrade, amendment, modification, or additional purchase must be arranged directly with the Hajj Provider.
Any payments relating to package upgrades or amendments must be paid directly to the Hajj Provider or through the authorised channels designated by the Hajj Provider.
Hajj Guides accepts no responsibility for any changes made by the Hajj Provider or Nusuk Hajj.

4. Additional Services Provided by Hajj Guides

From time to time, Hajj Guides may offer Additional Services for separate fees.

Where applicable:

Any fees charged by Hajj Guides will be clearly identified and communicated before purchase.
Such fees relate solely to the Additional Services provided by Hajj Guides.
Payments collected by Hajj Guides do not form part of any Hajj package payment.
Additional Services are separate from the contract between the pilgrim and the Hajj Provider.

Unless otherwise stated, fees paid for Additional Services may be non-refundable once the service has commenced or resources have been allocated.

5. Cancellations and Refunds

Hajj Package Cancellations

All cancellations, refunds, amendments, chargebacks, disputes, and compensation requests relating to Hajj packages are governed exclusively by:

Nusuk Hajj;
The relevant Hajj Provider; and
Applicable laws and regulations of the Kingdom of Saudi Arabia.

Hajj Guides is not responsible for determining, authorising, processing, or paying any refund relating to a Hajj package.

Additional Services

Where a cancellation relates to an Additional Service purchased directly from Hajj Guides, the cancellation terms applicable to that service will apply.

6. Health, Visa and Travel Requirements

You are responsible for:

Meeting all visa requirements;
Obtaining required vaccinations and health clearances;
Complying with travel regulations;
Maintaining valid travel documentation;
Complying with instructions issued by the Ministry of Hajj and Umrah, Saudi authorities, Nusuk Hajj, airlines, and the Hajj Provider.

While Hajj Guides may provide guidance and information, responsibility for compliance remains solely with you.

7. Data Protection and Privacy

Data Processed by Hajj Guides

Hajj Guides processes personal data in accordance with applicable United Kingdom data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Personal information provided to Hajj Guides may be collected and processed for purposes including:

Pilgrim support;
Administration;
Logistics planning;
Guide allocation;
Communication;
Seminar and webinar management;
Travel coordination;
Emergency assistance; and
Other legitimate operational purposes.

Sharing Data with Hajj Providers

You acknowledge and agree that personal information may be shared with:

The Hajj Provider;
Nusuk Hajj;
Saudi authorities;
Service providers involved in the delivery of Hajj services; and
Other organisations where necessary for administration, logistics, operational requirements, regulatory compliance, or pilgrim welfare.

Data Processed by Hajj Providers

Once personal data is provided to or shared with a Hajj Provider, Nusuk Hajj, or Saudi authorities, such data will be processed in accordance with the applicable laws and regulations of the Kingdom of Saudi Arabia, including the Saudi Personal Data Protection Law (PDPL) and related regulations.

Hajj Guides is not responsible for the privacy practices, policies, or processing activities of third parties.

8. Liability Disclaimer

Hajj Services

Hajj Guides acts solely as a guidance and support organisation and does not provide the Hajj package itself.

Accordingly:

We are not responsible for the performance of any Hajj Provider.
We are not responsible for accommodation allocations.
We are not responsible for transport arrangements.
We are not responsible for flight schedules or airline services.
We are not responsible for catering services.
We are not responsible for package changes.
We are not responsible for room allocations.
We are not responsible for itinerary changes.
We are not responsible for decisions made by Nusuk Hajj, the Hajj Provider, Saudi authorities, airlines, hotels, transport companies, or other third-party service providers.

Limitation of Liability

To the maximum extent permitted by law, Hajj Guides shall not be liable for:

Any indirect or consequential loss;
Loss of opportunity;
Loss of enjoyment;
Financial loss arising from Hajj package bookings;
Delays, cancellations, or disruptions;
Changes imposed by authorities or providers;
Errors made by third parties;
Acts of God;
Natural disasters;
Disease outbreaks;
Government restrictions;
Security incidents; or
Any event beyond our reasonable control.

9. User Conduct

You agree:

To provide accurate information.
Not to misuse our website or services.
Not to engage in unlawful, abusive, fraudulent, or disruptive behaviour.
To comply with all applicable laws and regulations.

We reserve the right to suspend or terminate access to our services where these terms are breached.

10. Intellectual Property

All content on this website, including text, graphics, branding, documents, educational materials, videos, guides, and other content, remains the property of Hajj Guides unless otherwise stated.

No content may be copied, reproduced, distributed, or used without prior written permission.

11. Changes to These Terms

Hajj Guides reserves the right to amend these Terms and Conditions at any time.

Any updates will become effective immediately upon publication on our website.

12. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

However, all Hajj package contracts, payments, refunds, cancellations, financial obligations, and provider services are governed by the terms, conditions, regulations, and applicable laws of the Kingdom of Saudi Arabia, including those imposed by the Ministry of Hajj and Umrah, Nusuk Hajj, and the relevant Hajj Provider.

Any disputes relating to Additional Services provided directly by Hajj Guides shall be subject to the jurisdiction of the courts of England and Wales.

Any disputes relating to Hajj packages, bookings, payments, refunds, or provider services shall be dealt with in accordance with the applicable rules, terms, and dispute procedures established by Nusuk Hajj, the Hajj Provider, and the Kingdom of Saudi Arabia.
